Marriage License Information Welcome to St. Croix County. This brochure provides you with Wisconsin Marriage License Information. If you are already married and want a copy of your marriage license, you need to contact the Register of Deeds office in the county in which you were married. A Wisconsin resident who will be getting married in Wisconsin must apply for the license at the County Clerk's office in the county where one of you has been living for the last 30 days; this license will be valid anywhere in Wisconsin. If you are getting married in Wisconsin, but NEITHER of you has lived in Wisconsin for the past 30 days, you must apply for the license in the County Clerk's office in the county where you will be married. WHEN TO APPLY Application should be made at least 6 days before, but not more than 30 days before the marriage date. If the couple should be unable to apply within the required time, the County Clerk may waive the waiting period. The fee for said waiver is $10.00. AGE REQUIREMENT You must be 16 years of age to marry in Wisconsin. Applicants under 18 years of age must have the written consent of both parents, or the guardian, the custodian as defined by law, or the parent having the actual care, custody and control of the person. The written consent must be given before the County Clerk under oath. Persons signing the consent form must present identification – a photo ID is preferred. CERTIFIED BIRTH CERTIFICATE Applicants MUST present a Certified Birth Certificate. A certified birth certificate has a raised seal from the State or County where they were born. Hospital Certificates and Notification of Birth Registration forms are not legal documents and are not acceptable. PROOF OF RESIDENCE Proof of current address is also required. Your current address is where you have actually lived for the past 30 days. A post office box is not acceptable. Acceptable proof would be a driver license, lease, utility statement, telephone bill, receipt, posted mail, etc. MARITAL STATUS If an applicant has been married before, they must provide proof that the last marriage has ended. If the last marriage ended in divorce, the divorce must be FINAL for at least 6 months regardless of where the action took place. Applicants that have been previously married, must present a death certificate, legal annulment, or a divorce judgment from their last marriage. An annulment issued by a church or religious organization is not a legal annulment and is NOT acceptable. The divorce judgment is usually part of the “Findings of Fact and Conclusions of Law”. The judgment must be signed and must indicate the date the action was final. A divorce must be final for at least 6 months before either party can be married regardless of where the judgment took place. COST The cost of a marriage license in St. Croix County is $100.00. This must be paid in cash or check. We do not accept credit or debit cards. ADDITIONAL INFORMATION Applicants are required to supply the following information, however, formal documentation is not necessary. Some items of information are strictly confidential and collected for statistical purposes only. In addition, your current address is also confidential information, but it can be released to law enforcement officers who present a written request. The license is valid for 30 days from the effective date and the marriage must take place within that period of time. If the marriage does not occur within the 30-day period, a new license must be obtained and fees collected again. Religious Ceremonies – Non-Wisconsin Resident Clergy: Per Wisconsin Statute 765.17 Nonresident officiating person; sponsorship. Any member of the clergy, licentiate or appointee named in s.765.16 who is not a resident of this state may solemnize marriages in this state if he or she possesses at the time of the marriage a letter of sponsorship from a member of the clergy of the same religious denomination or society who has a church in this state under his or her ministry.
